Free Trial refers to a limited period of time of access to the Service that may be free when purchasing a Subscription.
7-Day Trial refers to a seven-day period of time of access to the Service at a reduced Subscription fee when purchasing a Subscription.
Local Services refers to events such as “Weekly Classes’ and ‘Art Outdoors’
Product/Goods refers to any tangible items offered for sale on the Service
Service refers to the Website and digital products offered as part of the Website.
Subscription refer to the services or access to the Service offered on a subscription basis by the Company to You.
Teaching Practises refers to Digital Products, Local Services and the Service
Terms and Conditions (also referred as ‘T & C’s’ or ‘Terms’) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

You /User means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

These T & C’s apply between You and Moor to Sea Arts, the owner and operator of this website. Please read the T & C’s carefully as they affect your legal rights. Your agreement to be bound by these terms and conditions is deemed to occur upon your first use of the Website.
If you do not agree to be bound by these Terms and Conditions you should stop using the Website immediately.
You represent that you are over the age of 18. Moor to Sea Arts does not permit those under 18 to use the Service.
By using this Service you are also agreeing to be bound by our Privacy Policy.
We have taken all reasonable precautions to ensure the security of your personal data and order details. Accordingly, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to your information, either on our Website or our payment provider’s If you do not agree to be bound by the Privacy Policy you should not use the Service. These T & C’s may be varied by Us from time to time. Such revised Terms will apply to the Website from the date of publication. You should check the T &C’s regularly to ensure familiarity with the then current version.
These T &C’s contain the whole agreement between You and Moor to Sea Arts.

All Content on the website is the property of Moor to Sea Arts and other relevant third parties. By using the website you acknowledge that Content is protected by copyright, trademarks, database rights and other intellectual property rights. Moor to Sea Arts does not grant by implication or otherwise, any right to any Content on they Website that is covered by copyright or intellectual property law without prior written permission.
For your own personal use you may:
• use photographs supplied by us through our Teaching Practices for your own personal practice and portfolio.
• use paintings, sketches etc supplied by us through our Teaching Practices for your own personal practice and portfolio.
• display your copy at any Moor to Sea Arts event without giving credit to Siân Dudley or Rob Dudley (as applicable), because we all know where the original image comes from.
• display your copy in a third party public place (e.g. Facebook, your own website or your own exhibition) as long as you give credit to the original artist. An example credit would be ‘Based on an image by Artist Name’. If you are displaying it on the internet you should provide a link to our Website.
• You can make significant changes to the original image and then do what you want with it, including selling it, without giving credit (although it would be nice).
To clarify what you CAN NOT do:
• You CAN NOT make an obvious copy of one of our images or photographs and then sell it, either for your own personal gain or for charitable reasons.
• You CAN NOT make an obvious copy of one of our images , then make print or digital replicas and then give them away or sell them, either for your own personal gain or for charitable reasons.
• You CAN NOT make an obvious copy of our images and then use them as teaching material yourself.
Placing Orders for Goods and Services.
By placing an order for Goods or service through the Website you warrant that you are legally capable of entering into binding contracts. In order for Us to process Your order for Goods or Services You may be asked to supply certain information relevant to your order, including without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit/debit card and Your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.
By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order. The third parties we use are PayPal and Stripe. Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.
No contract shall exist between you and us for the sale of any goods until we accept your order after payment online.

DELIVERY
Please allow 30 days for delivery of physical Products/Goods. We aim to dispatch an order as soon as possible after the order has been accepted, but there may be delays. If we are unable to deliver within 30 days we will inform you as soon as possible. You will then have the option to cancel the order and receive a full refund. We will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.
We shall not be liable to you for any failure to deliver the goods that have been ordered by you or any delay, damage or defect to the goods collected which is caused by any event or circumstance beyond our reasonable control.

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

We reserve the right to refuse or cancel Your Order if fraud or an unauthorised or illegal transaction is suspected.
Your Order Cancellation Rights
In accordance with UK law you may cancel an order for goods for any reason within fourteen working days, beginning with the day on which you received the goods.
If you wish to cancel an order within this time frame, you should Contact Us. You will be responsible for the cost of returning the goods.
You must return the goods within fourteen days of cancellation and at your own expense. All returned items must be undamaged, in a condition suitable for immediate resale.
A refund will be issued once we have received the goods and checked their condition. Goods returned undamaged will receive a full refund, no later than 14 days from the day we receive them.
If the Goods returned show any signs of damage the amount of the refund we offer will be at our discretion.
We will use the same means of payment as You used for the Order, and You will not incur any fees for such reimbursement.

You will not have any right to cancel an Order for the supply of any of the following Goods or Services:
The supply of digital content which is not supplied on a physical (tangible) medium if the page on which the Content is available has been accessed, in which case We will assume the videos have been watched.
Physical Goods that are not in a resaleable condition and are deemed to be defective by the Company.
Refunds on Goods
Except when required by law purchased Products/Goods are non-refundable.
Certain refund requests for Goods may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company. To discuss a possible refund please contact Moor to Sea Arts.
Availability, Errors and Inaccuracies
We are constantly updating Our offerings of Goods and Services on the Website. The Goods and Servcies available on Our Website may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods and Services on the Website and in Our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
ARTWORK: We make every effort to ensure that all images are displayed as accurately as possible. However, we are unable to guarantee complete accuracy because the appearance of an image on screen is dependent up on the screen on which it is viewed. Colour, brightness levels, contrast and even resolution may vary from screen to screen. Please keep this in mind when viewing artwork on Our Website. In making a purchase you agree to accept these differences.
If we are unable, for any reason, to deliver the goods ordered by you, we will inform you of this as soon as possible and give you the option of providing you with substitute goods of equivalent quality and price, or a full refund.
Subscriptions
Subscription period
The Service or some parts of the Service are available with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of Subscription plan you select when purchasing the Subscription.
At the end of each Subscription period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.
Subscription cancellations
You may cancel Your Subscription renewal either through Your Account settings page or by contacting the Company, depending on the options given for Your particular Subscription plan.
You will not receive a refund for the fees You have already paid for Your current Subscription period unless covered by our Refund policy.
When Your Subscription renewal is cancelled You will be able to access the Service until the end of Your current Subscription period after which You will no longer be able to access the Service.
Billing for subscriptions
You shall provide the Company with accurate and complete billing information including full name, address, postcode /zip code, and valid payment method information.
Should automatic billing fail to occur for any reason, the Company will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Fee Changes
The Company, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.
The Company will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.
Refunds for subscriptions
Except when required by law paid Subscription fees are non-refundable. Certain refund requests for Subscriptions may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company.
Free Trial
The Company may, at its sole discretion, offer a Subscription with a Free Trial for a limited period of time.
You may be required to enter Your billing information in order to sign up for the Free Trial. If You do enter Your billing information when signing up for a Free Trial, You will not be charged by the Company until the Free Trial has expired. On the last day of the Free Trial period, unless You have canceled Your Subscription, You will be automatically charged the applicable Subscription fees for the type of Subscription You have selected.
At any time and without notice, the Company reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
User accounts
When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.
You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorised use of Your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene.
Termination of your account
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.

In addition to these T & C’s additional T & C’s apply for Weekly Classes and Art Outdoors. Please read these additional T &C s before booking a place in these events.
Prices Policy
The price and description of the Goods are displayed on our Website. Such information is subject to change without notice.
In the event that you order an item and the price published on the Website is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or, if you choose, to cancel the order. If you choose to cancel the order we will issue a full refund of any amount charged.
You may choose to pay by credit or debit card. We use third party payment processors who use encryption technology to ensure a secure checkout.
The price of the goods is payable in full at point of sale.
Receipts for payment will be sent by email after payment for any purchases made online from the Site. All goods remain our property until cleared payment is received from you.
SHIPPING
UK destinations: P&P which will be calculated and added at checkout before you complete the transaction.
Destinations outside UK: Please contact us before purchasing. We will not fulfil orders for physical Products/Goods to destinations outside the UK without prior arrangement. Should you make a purchase through our Site without having first contacted us your payment will be refunded minus an admin fee of £10 or 10% of the value of the order, whichever is greater. By contacting us before purchase we may be able to agree shipping fees which will be in addition to the price of the items you wish to purchase.
Note that all original artworks are supplied unframed. The size of the artwork stated on the website is the size of the image. The support (paper, board or canvas) may be slightly larger to allow for framing.
Original paintings are shipped flat packed.
Fine Art Prints are shipped rolled in postage tubes with insurance. It is advisable to unroll the print as soon as possible after receiving it/them, and to store them flat prior to framing.
Please be aware that if an arrangement has been made to ship outside the UK your purchase may be subject to import duty in the destination shipping country. Payment of such fees is your responsibility.
Availability of Website and Disclaimers
Any online facilities, tools, services or information that Moor to Sea Arts makes available through the Website (the Service) is provided ‘as is’ and on an ‘as available’ basis. We give no warranty that the Service will be free of defects and /or faults. To the maximum extent permitted by law, we provide no warranties, (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality and is under no obligation to update information on the Website.
Whilst Moor to Sea Arts uses reasonable endeavours to ensure the the Website is secure and free of errors, viruses and other malware, we give no warranty or guarantee in that regard and all Users take responsibility for their own security, that of their personal details and their computers.
Moor to Sea arts accepts no liability for any disruption or non-availability of the Website.
Moor to Sea arts reserves the right to alter, suspend or discontinue any part (or the whole) of the Website including but not limited to any products and /or Services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.
